Women's Health Services v. Maher
Abstract
KIE: On remand, the U.S. District Court for the District of Connecticut ruled that a challenge to the constitutionality of a Connecticut abortion regulation did not raise a serious issue on the merits which presented a fair ground for litigation. The regulation allowed Medicaid reimbursement only when, in the professional judgment of a physician, the mother's life would be endangered if the fetus were carried to term. The court was bound by the decision of the U.S. Supreme Court in Harris v. McRae that federal funding for abortion could be limited to such circumstances without violation of the equal protection and due process clauses of the Fourteenth Amendment.
