Glick v. McKay

U.S. District Court, D. Nevada. Fed Suppl. .

Abstract

KIE: In a challenge to the Nevada abortion statute, the U.S. District Court for the District of Nevada enjoined the provisions requiring parental notification or court authorization before the performance of an abortion on a dependent minor. The court ruled that the procedures for obtaining a judicial order authorizing an abortion failed to preserve confidentiality and might present hardships to a minor who was capable of making an independent decision regarding abortion. However, following the precedent of the U.S. Supreme Court in City of Akron v. Akron Center for Reproductive Health, the statute was constitutional in requiring physicians to explain the physical and emotional implications of having an abortion.
