Goldberg v. Ruskin
Abstract
KIE: The parents and a child born with Tay Sachs disease brought suit for wrongful life and wrongful birth against their physician and the physician's employer because the physician did not inform the parents of their risk as carriers of Tay Sachs, test them, or subsequently test for an affected fetus. The Illinois Appellate Court affirmed the Circuit Court's dismissal of the claim for wrongful life, because the child sought to recover only for pain and suffering, not for medical expenses. The parents' cause of action for wrongful birth was recognized, and they were allowed to seek recovery of expenses arising from the care and treatment of the child's impairments.
