Towards a definition of the right to food and nutrition: reflections on General Comment No. 12

Abstract

PIP: This article presents reflections of Wenche Barthe Eide and Uwe Kracht of the Administrative Committee on Coordination/Sub-Committee on Nutrition Working Group on Nutrition, Ethics and Human Rights on issues related to the right to food and nutrition. One of the significant steps taken towards an authoritative definition of the human right to food is the adoption of the 12th General Comment by the International Covenant on Economic, Social and Cultural Rights. The General Comment was created to monitor compliance with the International Covenant on the right to adequate food. Since 1994, there has been an ongoing discussion regarding whether or not the three levels of obligation should be expanded to four levels, namely the obligations to respect, protect, facilitate, and fulfill. The reason has been the felt need to distinguish between the right to receive assistance to feed oneself, and the right to be directly provided with food through safety nets and social programs. As it has been shown, General Comment No. 12 may pave the way for improved guidelines for reporting on the realization of the right to adequate food in any country.
