Abstract

PIP: The court held that Article 3(1) of Decree-Law No. 722 of 21 November 1945 violates Article 3 of the Italian Constitution, which requires equality of treatment of the sexes. The challenged Article provides benefits to a husband when his wife is unemployed, but provides benefits to a wife only if the husband is unemployed and permanently unable to work.
